Judgment in Strasbourg on the complaints of two refugees

Expulsions conducted by Spain at the EUs external borders violate the
European Convention on Human Rights

Berlin/Strasbourg, 03 October 2017  Spanish authorities systematically and
often violently expel refugees and migrants at the border with Morocco. This
long-standing practice of push-backs at the external borders of the European
Union (EU) is unlawful. Automatic expulsions violate the European Convention
on Human Rights (ECHR),  <https://t.co/9NVdK9K1tp> as the European Court of
Human Rights (ECtHR) today ruled in Strasbourg. The judgment came in
response to
<https://www.ecchr.eu/en/our_work/international-crimes-and-accountability/mi
gration/melilla.html> two complaints against Spain brought to the ECtHR in
February 2015 by two refugees from Mali and Cote dIvoire based on the
initiative and expertise of the European Center for Constitutional and Human
Rights (
<https://www.ecchr.eu/en/our_work/international-crimes-and-accountability/mi
gration.html> ECCHR). The Courts decision states that Spains push-back
practices at the Spanish-Moroccan border are in violation of Article 4
Protocol 4 (prohibition of collective expulsions) and Article 13 (right to
an effective remedy) ECHR. 

N.D. and N.T. (whose names are anonymized for protection reasons) crossed
the border fence structure in Melilla and entered Spain on 13 August 2014.
The Spanish Guardia Civil apprehended them, along with approximately 70
other individuals from Sub-Saharan Africa who also had overcome the fences,
in order to literally push them back to Morocco immediately  without
access to any legal procedures or protection. Their complaints are supported
by ECCHR in cooperation with

Welt, and they are represented by ECCHRs cooperating lawyers in Madrid and
Hamburg. In further ECtHR proceedings, ECCHR is supporting the complaints of
refugees from Syria, Iraq, and Afghanistan against their unlawful expulsion
near Idomeni at the Greek-Macedonian border. 

The litigation against Spain has an impact beyond the individual case. It
sets a precedent in order to assert the fundamental right to have rights of
refugees and migrants, said ECCHR General Secretary Wolfgang Kaleck. The
ECtHR judgment clarifies that Spains border regime violates human rights,
because the Convention also applies at the external borders of the EU.

ECCHR cooperating lawyer Gonzalo Boye said: The Spanish government  in
particular the Interior Minister Juan Ignacio Zoido  has to act now and
repeal the law on the Protection of Public Safety (Ley de protección de
la seguridad ciudadana"). This law, in force since April 2015, stipulates
that people who try to cross the border fence structure of Ceuta and Melilla
can be rejected, i.e. immediately returned to Morocco.

Urteil in Straßburg zu Beschwerden von zwei Geflüchteten 

Spaniens Abschiebungen an den EU-Außengrenzen verstoßen gegen die
Europäische Menschenrechtskonvention

Berlin/Straßburg 03. Oktober  2017  Spanien schiebt an der Grenze zu
Marokko Geflüchtete und Migrant_innen systematisch und häufig brutal zurück.
Diese langjährige Praxis der Push-Backs an den Außengrenzen der Europäischen
Union (EU) ist rechtswidrig. Sie verstößt gegen die Europäischen
Menschenrechtskonvention (EMRK) urteilte nun der Europäische Gerichtshof für
<https://t.co/9NVdK9K1tp>  Menschenrechte (EGMR) in Straßburg. Anlass der
Entscheidung waren Beschwerden

ntwortung/migration-und-flucht/melilla.html>  gegen Spanien, die zwei
Geflüchtete aus Mali und der Elfenbeinküste auf Initiative und mit Expertise
des European Center for Constitutional and Human Rights (ECCHR
<https://www.ecchr.eu/de/home.html> ) im Februar 2015 beim EGMR eingereicht
hatten. Mit der Abschiebepraxis an der Grenze zu Marokko verstoße die
spanische Regierung gegen Artikel 4 des Vierten Zusatzprotokolls (Verbot der
Kollektivausweisung) und gegen Artikel 13 (Recht auf effektive Rechtsmittel)
der EMRK, so der EGMR. 

N.D. und N.T. (zum Schutz der Kläger werden nur die Initialen genannt) waren
am 13. August 2014 über die Grenzanlage bei Melilla nach Spanien gelangt.
Sie wurden mit etwa 70 weiteren Geflüchteten aus Subsahara-Afrika, die
gemeinsam mit ihnen die Zäune überwunden hatten, festgenommen und umgehend
von der spanischen Guardia Civil buchstäblich nach Marokko zurückgeschoben
-  ohne Verfahren und ohne Rechtsschutzmöglichkeit. Ihre Beschwerden wurden
vom ECCHR in Kooperation mit Brot
<https://www.brot-fuer-die-welt.de/themen/hintergruende-zur-flucht/>  für
die Welt unterstützt, vertreten wurden sie von ECCHR-Kooperationsanwälten in
Madrid und Hamburg. In einem weiteren EGMR-Verfahren unterstützt das ECCHR
Geflüchtete aus Syrien, Irak und Afghanistan in deren Beschwerden wegen der
illegalen Rückschiebung nahe des Lagers Idomeni an der
mazedonisch-griechischen Grenze.

Das Melilla-Verfahren hat weit über den Einzelfall hinaus Wirkung. Es ist
ein Präzedenzfall, um das grundlegende "Recht auf Rechte" von flüchtenden
und migrierenden Menschen durchzusetzen, sagte Wolfgang Kaleck,
Generalsekretär des ECCHR. Mit dem Urteil stellt der EGMR klar: Spaniens
Grenzregime ist menschenrechtswidrig, denn die EMRK gilt auch an den
Außengrenzen der EU.

Der ECCHR-Kooperationsanwalt aus Madrid, Gonzalo Boye, forderte: Die
spanische Regierung  allen voran Innenminister Juan Ignacio Zoido  muss
jetzt handeln und das so genannte Gesetz zum Schutz der Bürger-Sicherheit
(Ley de protección de la seguridad ciudadana") zurücknehmen. Das Gesetz
gilt seit April 2015 und sieht vor, dass Menschen, die die Grenzanlagen von
Ceuta oder Melilla zu überwinden versuchen, zurückgewiesen, d.h. unmittelbar
zurückgeschoben, werden können.
