New evidence added to criminal complaint on US torture program 

Torture: CIA deputy Gina Haspel must face arrest on travelling to Germany or
Europe

Berlin, 7 June 2017  An arrest warrant for CIA Deputy Director Gina Haspel:
thats the aim of a new dossier from the European Center for Constitutional
and Human Rights (ECCHR <https://www.ecchr.eu/en/home.html> ) submitted to
the German Federal Public Prosecutor (Generalbundesanwalt) in Karlsruhe.
Haspel was appointed to the position by US President Donald Trump in
February 2017. The information submitted by ECCHR on 6 June 2017 documents
Haspels role in the torture of detainees while she was serving as head of a
secret CIA prison in Thailand. In the dossier, ECCHR argues that Haspel
oversaw the daily torture of detainees at the black site in 2002 and failed
to do anything to stop it. 

Those who commit, order or allow torture should be brought before a court 
this is especially true for senior officials from powerful nations, said
ECCHRs General Secretary Wolfgang Kaleck. The prosecutor must, under the
principle of universal jurisdiction, open investigations, secure evidence
and seek an arrest warrant. If the deputy director travels to Germany or
Europe, she must be arrested.

The dossier on Haspel is a follow-up to ECCHR

program filed with the Federal Public Prosecutor on 17 December 2014. Over
the past years we have provided the prosecutor with extensive evidence on US
torture as well as the names of torture survivors and former US officials
who are willing to give evidence, said Kaleck. By pursuing investigations
into the US torture program, Germany can help to ensure that those
responsible for rendition, torture and unlawful detention do not go
unpunished. 

ECCHR also submits that former CIA director George Tenet, former Secretary
of Defense Donald Rumsfeld and other high-level Bush administration
officials committed the war crime of torture under Paragraph 8 Section 1(3)
of the German Code of Crimes against International Law
(Völkerstrafgesetzbuch). That acts of torture occurred under the Bush
administration was confirmed in the US Senate Intelligence Committees
report on CIA interrogation.

Neue Beweise ergänzen Strafanzeige wegen US-Folterprogramm

Folter: CIA-Vize Gina Haspel muss bei Einreise nach Deutschland oder Europa
festgenommen werden

Berlin, 7. Juni 2017  Ein Haftbefehl gegen die stellvertretende Direktorin
des US-Geheimdienstes CIA, Gina Haspel: Das ist das Ziel eines neuen
Schriftsatzes des European Center for Constitutional and Human Rights (ECCHR
<https://www.ecchr.eu/de/home.html> ) beim Generalbundesanwalt (GBA) in
Karlsruhe. Haspel wurde im Februar 2017 von US-Präsident Donald Trump
ernannt. Die Informationen, die das ECCHR am 6. Juni 2017 beim GBA
einreichte, dokumentieren die Rolle Haspels bei der Folter von Gefangenen
als Leiterin des CIA-Geheimgefängnisses Thailand. Dort habe Haspel im Jahr
2002 die Folter von Gefangenen täglich überwacht und sei nicht dagegen
eingeschritten.

Wer foltert, foltern lässt oder Folter billigt, gehört vor Gericht  das
gilt insbesondere für hochrangige Verantwortliche aus mächtigen Nationen,
sagte ECCHR-Generalsekretär Wolfgang Kaleck. Der Generalbundesanwalt muss
nach dem Weltrechtsprinzip gegen Haspel ermitteln, Beweismittel sichern und
auf einen Haftbefehl hinwirken. Sollte die CIA-Vizedirektorin nach
Deutschland oder Europa einreisen, muss sie verhaftet werden.

Das Dossier zu Haspel ergänzt die ECCHR-Strafanzeige

GBA seit dem 17. Dezember 2014 vorliegt. Wir haben dem GBA in den
vergangenen Jahren etliche Beweismittel zum US-Folterprogramm vorgelegt
sowie Folter-überlebende und aussagewillige ehemalige Amtsträger aus den USA
als Zeugen benannt  die deutsche Justiz kann also jederzeit aktiv werden,
sagte Kaleck. Mit Ermittlungen zum US-Folterprogramm könnte Deutschland
einen Beitrag leisten, damit die Verantwortlichen für Verschleppungen,
Folter und illegale Inhaftierungen nicht straffrei bleiben.

Das ECCHR wirft dem ehemaligen CIA-Chef George Tenet, dem ehemaligen
US-Verteidigungsminister Rumsfeld und anderen hochrangigen Beamten der Ära
Bush Kriegsverbrechen der Folter nach § 8 Abs. 1 Nr. 3 Völkerstrafgesetzbuch
(VStGB) vor. Den Tatbestand der Folter hatte auch der Geheimdienstausschuss
des US-Senats in seinem Bericht zu den CIA-Verhörmethoden befunden.
