European Asylum Support Office

EC1F527E6BA780> European Ombudsman will examine practices by the European
Asylum Support Office ( <https://www.easo.europa.eu/> EASO) at hotspots
(reception centers) in Greece. The move comes in response to a complaint
about the inadmissibility decisions taken under the EU-Turkey agreement. The
complaint was filed by the European Center for Constitutional and Human
Rights ( <https://www.ecchr.eu/en/home.html> ECCHR) with the support of

Welt in April 2017. 

EASOs activities at the Greek hotspots violate their own guidelines and go
beyond the scope of its competence under EU law, said ECCHR General
Secretary Wolfgang Kaleck. EASO tries to publicly downplay the role it
plays,  <https://euobserver.com/migration/137762> claiming it is merely
providing support to the Greek authorities. In reality, Greeces decisions
on the inadmissibility of asylum applications are based on EASO interviews
and recommendations; officials from the Greek Asylum Service make their
decisions based on the information in the file without direct contact with
the applicants in those cases. We very much welcome the EU Ombudsmans
decision to examine the lawfulness of EASOs work in Greece, said Kaleck. 

The EU-Turkey Statement of 18 March 2016 aims to return [a]ll new irregular
migrants crossing from Turkey into Greek islands. However, asylum seekers
cannot be returned based on a generalized consideration of Turkey as a safe
third country and without an individual review of the particular situation
of the person concerned. The admissibility interviews undertaken by EASO
deny asylum seekers a fair hearing and the chance to adequately present
their case. This is the conclusion of ECCHRs research and the basis of the
complaint against EASO.

Asyl-Prüfungen in griechischen Hotspots: EU-Ombudsmann untersucht Arbeit des
europäischen Asyl-Büros EASO

Berlin, 6. Juni 2017  Die Europäische Bürgerbeauftragte (EU-Ombudsmann
<https://www.ombudsman.europa.eu/de/home.faces> ) wird das Vorgehen des
European Asylum Support Office (EASO <https://www.easo.europa.eu/> , dt.
Europäisches Unterstützungsbüro für Asylfragen) in den Erstaufnahmelagern
für Asylsuchende (auch Hotspots genannt) in Griechenland prüfen. Damit
reagiert die Bürgerbeauftragte auf eine Beschwerde über Missstände bei den
Asyl-Zulässigkeitsentscheidungen im Rahmen des EU-Türkei-Abkommens. Die
Beschwerde hatte das European Center for Constitutional and Human Rights
(ECCHR <https://www.ecchr.eu/de/home.html> ) mit Unterstützung von Brot für
die Welt <https://www.brot-fuer-die-welt.de/>  im April 2017 eingereicht. 

EASO verstößt mit seinem Vorgehen in den griechischen Hotspots gegen seine
eigenen Leitlinien und überschreitet seine europarechtlichen Kompetenzen,
sagte ECCHR-Generalsekretär Wolfgang Kaleck. EASO versuche zwar, öffentlich
die eigene Rolle herunter zu spielen und behaupte

lediglich die griechischen Behörden. De facto aber basieren deren
Zulässigkeits-Entscheidungen auf Interviews von EASO und einer
abschließenden Bewertung durch die EU-Agentur. Die  Beamt_innen der
griechischen Asylbehörde (GAS) entscheiden auf Grundlage von EASOs
Informationen und haben in diesen Fällen selbst keinen unmittelbaren Kontakt
mit den Schutzsuchenden. Wir begrüßen es sehr, dass die Bürgerbeauftragte
nun die Rechtmäßigkeit der Aktivitäten von EASO in Griechenland untersucht,
so Kaleck. 

Das EU-Türkei-Abkommen vom 18. März 2016 strebt Rückführungen aus
Griechenland, beziehungsweise aus den Hotspots, in die Türkei an. Diese
bedürfen jedoch in jedem Einzelfall einer Prüfung, ob ein Asylverfahren
zulässig ist beziehungsweise ob die Türkei für die betreffende Person einen
sicheren Drittstaat darstellt. In den Zulässigkeitsinterviews verwehrt
EASO Asylsuchenden die Chance auf eine faire Anhörung und damit die
Möglichkeit, ihr Gesuch ausreichend darzulegen. Das ist das Ergebnis der
ECCHR-Recherche und die Grundlage der Beschwerde gegen EASO.
